Critical habitat cases

Indiana Supreme Court holds that Indiana Department of Environmental Management (IDEM) "is within its statutory authority to require NPDES permits for the discharge of fill material into waters of the state previously regulated under the Section 404 program. Private ponds, when the discharges from these ponds cause or threaten to cause water pollution, and some isolated wetlands are waters of the state. We leave it to the regulatory process to determine in the first instance whether permits are required and, if so, should be issued in this case" (IDEM v. Twin Eagle LLC, No. 49S00-0204-CV-237)

In the Hawaiian longline fishery case, the fishing groups have asked the judge for a 45-day stay in the case so an "interim management regime" can be put in place. HLA also wants NMFS to complete reconsultation in 60 days. The government believes current restrictions on fishing to protect sea turtles should remain in place. The National Wildlife Federation files 60-day notice of intent to sue over abandonment of Northeast wolf recovery efforts. NWF said the final wolf reclassification rule issued in April "effectively terminates federal wolf recovery efforts in the Northeast, where suitable wolf habitat exists and wolves are apparently beginning to return."
