Endangered Species & Wetlands Report is a newsletter published 11 times per year that covers the Endangered Species Act, wetlands and private property rights issues. ESWR was founded in October 1995 by Editor and Publisher Steve Davies and is not affiliated with any other individuals or groups.

ESWR's tagline on the front page says we cover Congress, the courts and federal agencies. Over the years, that has evolved into more coverage of ESA, wetlands and takings litigation, with ESA stories outnumbering those on wetlands, and takings in third place. Congressional affairs, with the exception of appropriations bills, have received less coverage in recent years because Congress appears unable to reauthorize either the ESA or the Clean Water Act. Thus the hearings that are held, while occasionally entertaining, often result in very little action.
[Update, March 2005. That could change this year, with members in the House and Senate saying they want to work together to reauthorize the ESA. Update, January 2007: Didn't happen. And now Richard Pombo is out, Lincoln Chafee is out, and the Democrats are in the majority in both Houses. I would never say they are in control of them. Do not look for any ESA reauthorization action in this Congress. Clean Water Act, maybe.]
ESWR reports on decisions by the federal
circuit and district courts, as well as the Supreme Court.

We also cover the Fish and Wildlife Service's listing and critical habitat decisions under the ESA, wetlands regulation by the Army Corps of Engineers and the Environmental Protection Agency, and takings decisions from the U.S. Court of Federal Claims and Federal Circuit Court of Appeals.
Each month, ESWR also summarizes important Federal Register notices on the ESA, which are posted here . Subscribers receive e-mail updates in between issues of court decisions and other news items.
The price for a new subscription is $195, which is $150 less than the regular printed rate of $345, and $100 off the PDF email rate of $295.
ESWR also offers special rates. Small nonprofit groups (those with budgets under $1.5 million per year) can get the newsletter for $150 per year. Students can get it for $90/year.
Please also ask us about site licenses. ESWR will negotiate such licenses with companies, government agencies or any organization that believes more than one person would want to see the newsletter. We can give you a good deal that would allow your organization to distribute the newsletter to a specified number of people for a set price.
